MEMBERSHIP RENEWALS:

It’s great to see the continued use by members of our new online membership system. To date, we have had more that 60 members renew using our new system.

Some members have called to say that they haven’t yet received an invoice for their membership. Please note that invoices will be issued only after you have completed your online submission, as the details that you enter are being captured for the production of our online members’ database.  

Remember to join or renew before 17 February 2012 to receive a 5% discount off the membership fee.

FIRST NETWORKING EVENT OF THE YEAR

The first networking event of 2012 was a business breakfast, sponsored by the DRTCC and with Ian Shepherd, Acting District Coordinator, from Workcover NSW as the guest speaker. Many thanks to DRTCC for sponsoring the event.

 

Ian spoke to us about the new Workplace Health and Safety laws that came into effect on 1 January 2012.

 

Over the next couple of weeks, the newsletter will include some key points from Ian’s presentation.

 

This week’s instalment focuses on employers and workers.

  • The term “employers” has been replaced by “persons conducting a business or undertaking (PCBU)”; and “employees” is replaced by “workers”
  • A PCBU may be an individual person or an organisation conducting a business or undertaking. Examples of PCBUs who are individuals include: 
    o partners in partnerships 
    o sole traders and self employed people 
    o individual trustees of trusts (as with some family businesses) 
    o committee members of unincorporated associations if they employ someone.
  •  Examples of PCBUs that are organisations include: 
    o public companies 
    o private companies 
    o trustees that are companies 
    o cooperatives that are companies 
    o government departments and authorities 
    o incorporated associations if they employ someone 
    o local authorities (municipal corporations or councils) 
    o independent schools 
    o universities. 
  • The term 'worker' includes any person who works as an:
    o employee 
    o trainee 
    o volunteer 
    o outworker 
    o apprentice 
    o work experience student 
    o contractor or sub-contractor 
    o employees of a contractor or sub-contractor 
    o employee of a labour hire company assigned to work for a PCBU.
  •  An officer is a broad term that applies to people who can make decisions that significantly affect a business or undertaking.
  • An officer can be:
    o a director or secretary of a corporation 
    o any person who can make, or participate in making, decisions that affect the whole, or a substantial part, of the business of the corporation 
    o a person who has the capacity to affect significantly the corporation’s financial standing 
    o a receiver, or receiver and manager, of the property of the corporation 
    o an administrator of a corporation 
    o an administrator of a deed of company arrangement executed by a corporation 
    o a liquidator of a corporation 
    o a trustee or other person administering a compromise or arrangement made between the corporation and someone else.
  • An officer can delegate a task for WHS, but not the responsibility for WHS.
